1. HOW IMPORTANT ARE THESE TERMS?
It is very important that you carefully read the following Terms as they contain important information regarding how to use the Services, your legal rights, remedies and obligations. These Terms are taking the form of questions & answers for simplicity and for your ease of read.
Legally speaking this document represents Vodafone’s conditions to use the Services. If you choose to accept them, then it will be considered the “contract” that binds you with Vodafone and with the suppliers who provided the E-books and other content on the Kotobi application.
2. WHAT IS KOTOBI AND WHAT ARE THE SERVICES OFFERED?
“Kotobi” or “Kotobi Services” is the name given to our web-based Application, from which you can access and read certain digital (i.e. non-paper based) books and periodicals (the “Ebook(s)”).
You will be able read the Ebook you choose in return for a sum of money (the “Price”) you will have to pay.
3. WHO IS OFFERING THESE SERVICES?
The hosting and operation of the Kotobi Services is provided by Vodafone Egypt and its affiliated companies. The EBooks are offered by several Publishing Houses and Newspaper agencies (the “Suppliers”) who legally owns all the intellectual property rights to such Ebooks.
The name of the each Supplier will individually appear on the specific Ebook you choose to download.
4. HOW CAN I DOWNLOAD AND ACCESS EBOOKS?
First of all, there are certain pre-requisites before downloading and reading Ebooks.
Secondly you have to register by visiting the following link: www.kotobi.com and create a new account or use your existing Facebook© account to register.
Finally, in order to download and read the Ebook you should download our free Kotobi application available on Appstore© or Google Play.© Once downloaded you should be able to read any Ebook you choose that will be displayed on the Kotobi Application shelves after pressing the “refresh” button after each purchase.
5. HOW CAN I PURCAHSE AND PAY FOR THE EBOOKS?
The Purchase of the Ebook can only be made from the following link www.kotobi.com.
You can pay for the Ebook by using any of the following methods:
1- Through Vodafone’s Pre-Paid Cards
You can pay the Ebook by using a Vodafone Pre-Paid Card. The price of the Ebook shall be deducted from the balance of the Pre-Paid Card. There is no limitation on the number of Ebooks you can purchase using the Pre-Paid Card.
2- Through payment added to your monthly Vodafone bill.
You can make a payment for the Ebook that will be added to your monthly Vodafone bill by entering your mobile number. You will then receive a “code” that enables you to download the Content. The code is valid for only 18 minutes, however, you can generate a new code, for free, at any time by clicking on the “Generate Code.” After entering the code, you will click on the “confirm purchase button.”
A SMS will be sent to you to confirm the purchase and the payment shall be automatically added to your monthly bill under the mention “Kotobi – Purchase of Ebooks.”
There will be a limit to the number of Ebooks you can purchase under this payment method– this is set and amended freely by Vodafone from time to time.
3- By Credit Card
You can pay by credit card whether you are located in Egypt or abroad. If you use your Credit Card you will be redirected to our bank secured web page to proceed with payment. A banking fee of one (1) EGP will apply in case your purchases are less than twenty (20) EGP.
6. DO I OWN THE E-BOOKS I PURCHASED?
The Ebook is the property of the Suppliers and/or its Author and is protected by the local and worldwide copyright laws and treaties. You do not acquire ownership rights to any of the Ebook by downloading any Content.
Accordingly, you may not re-sell, share, rent, dispose or reproduce in any format any of the Ebook you downloaded whether for free or in return of a sum of money.
Generally, you agree to abide by any and all additional copyright notices, information, or restrictions associated with the Content. You agree that you will not in any way infringe, either directly or indirectly, the Suppliers’ and Author's copyrights in and to the Content.
7. HOW AND WHERE CAN I USE THE CONTENT?
You are allowed to install and use the Ebooks on up to four (4) personal electronic devices used by you or members of your immediate family using same credentials.
8. IS THERE A RETURN POLICY?
The Ebook purchased cannot be returned and is not refundable.
9. IS THERE OTHER INFORMATION I NEED TO KNOW?
Yes please read carefully these limitation and disclaimers:
1) Availability of the Kotobi Services:
While Vodafone will make all reasonable efforts to ensure that your access to the E-books and the Kotobi Service are available at all times, Vodafone does not guarantee, represent or warrant that your access to the Service or the E-books will be uninterrupted or error-free.
In addition, while Vodafone and its Suppliers each makes reasonable efforts to ensure that all Content and/or information submitted by you to Vodafone will be secure, Vodafone does not guarantee that Service and access to the E-books will be free from loss, corruption, attack, viruses, "worms", "trojan horses" or other harmful components, or from interference, hacking or other security intrusions. Vodafone may also impose limits on the use of or access to certain features or portions of the Service, in any case without notice or liability.
Vodafone may also at its own discretion refine the Kotobi Application to realize necessary adaptations to technological developments, during such period the use of the Kotobi Services may be interrupted.
2) Termination of the Kotobi Services:
Vodafone’s intention is to provide the Service for an unlimited period. However, Vodafone shall be entitled to cancel access to the Kotobi Service at any time. This could result from event of Force Majeure that is not under our control, or in case Vodafone desire to discontinue the Services for commercial and/or Financial reasons.
In the event of the termination of the Service with respect to Kotobi or the discontinuation of an E-book title, Vodafone shall on a best effort basis, will provide each User will be provided with a weblink where you will find the Ebooks you purchased.
3) Disclaimer and limitation of liability:
The Ebooks, the Application and other Kotobi services are provided "as is" and without warranties of any kind either express or implied. Vodafone is not responsible for any personal expectation you had in regard to the Ebooks or the Kotobi Services or any losses direct or indirect you may sustain as a result of accessing or failure to access the Kotobi Services.
IN NO EVENT SHALL VODAFONE’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE OR SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEEDNG THE DATE THE CLAIM ARISES.
Vodafone shall have the discretion to sell the Kotobi Application or assign its rights and obligations under these Terms to any third parties, without affecting your rights under the present Services. Upon such assignment Vodafone shall be relieved of any further obligation under these Terms.
Vodafone may at its discretion change the above terms and conditions, its payment method, or the prices of the Ebooks at any time, with or without notice to you.
